Md. Abdul Baten vs Vebla Chandra Mistry @ Molin and ors.

Code of Civil Procedure, 1908 (V of 1908), Section—115(1)
The Lower Appellate Court being the fi-nal court of fact has held that plaintiffs have proved their prima facie title in the suit land and their exclusive possession. The lower court recorded finding with regard to prima facie title and exclusive possession of plaintiff on consideration of evidence on record. The suit land has been described in the plaint with plot number, khatian number, area and boundary. There is no vagueness in the de-scription of suit land. There is no illegality in the judgment of the Lower Appellate Court.

Md. Faroque Hossain vs Mr. M. Iqbal Hossain and others

Contempt of Court Act, 1926 (XII of 1926)
In contempt matters the intention of the contemner is not relevant. It is the effect of the contemner's action which is to be taken into account in deciding whether contempt was committed or not. The effect of the contemner's action is that the sanctity of the Court's order has been flouted. It must be made clear that when this Court passes an order it is meant for execution and not for flouting it. (Para—23)

The general notion in currency that the contempt application is not an execution proceeding and no consequential relief can be given in contempt proceedings is an erroneous view. It is wellsettled that in an appropriate case the mere imposition of imprisonment or fine or both may not meet the ends of justice and there it may be necessary to pass an order to purge the contempt by directing the contemner to implement the judgment issuing necessary and consequential directions for enforcing the same.(Para—26)

Government of Bangladesh and others vs Md. Sharifuddin Mollah

Police Officers (Special Provisions) Ordinance, 1976 (Ordinance No. LXXXIV of 1976), Section—3, Police Regulation of Bengal (PRB), Regulation—858(a)(1)
There are two parts of section 3 of the Ordinance. The second part indicates that the overriding provision in the first part of section 3 does not exclude the operation of the law, rules and regulations including PRB in force prior to the promulgation of the Ordinance. It is for the authority to decide whether a delinquent police personnel would be proceeded under the Ordinance or pre-existing law/rules. As pre-existing law remained valid, disciplinary proceedings under Regulation No. 858 of the PRB has been legally initiated. Moreover, Regulation 858 (a)(2) empowers the Superintendent of Police to award a police personnel, i.e. Sub-inspector of Police, any punishment, i.e. dismissal, removal, which may be awarded by the Inspector General or Deputy Inspector General of Police under Regulation No. 858(a)(1). Thus AT was in error in holding that Superintendent of Police can only award punishment to Sub-Inspector of Police can only award punishment to Sub-Inspector of Police under Regulation 858(a)(1)(iv), i.e. censure or reprimand. Adjournment
Adjournment of a case is essentially a matter of discretion of the Court, but it has to be exercised judicially. Adjournment cannot be allowed as a matter of course, even if both the parties ask for it. No adjournment should be granted unless "sufficient cause" is made out for it.

Mohammad Moniruzzaman & anr. V The State and another

Code of Criminal Procedure, 1898 (V of 1898) Sections—436 & 561-A it appears from the order of the learned Metropolitan Sessions Judge that he has directed the Chief Metropolitan Magistrate to send the case for further investigation and also directed the Officer –in- Charge, Pahartoli police Station to hold further investigation by himself, but he can not pass such order under Section 436 of the Code of Criminal Procedure. He can only send for further inquiry by setting aside the order of discharge and such direction to hold further investigation is an abuse of the process of law. The learned Sessions Judge while passing such order ought to have directed for further inquiry but further direction to the Police Officer –in-Charge Pahartoli Police Station to hold further inquiry by himself is wholly without any jurisdiction.
